Section 13 of the Firearms Control Act is designed to allow private individuals to legally possess a firearm strictly for the purpose of self-defence. Its intention is to provide an avenue for civilians who face genuine, unavoidable risks in their daily lives to protect themselves when ordinary security measures are not sufficient. The category is deliberately narrow and focused, ensuring that firearms issued under Section 13 are justified by real personal safety concerns rather than recreational interests.
Under this section, an individual may possess only one firearm suitable for self-defence, typically a handgun such as a revolver or semi-automatic pistol, or in some cases a manually operated shotgun. Semi-automatic shotguns and semi-automatic rifles are not permitted for this licence type, and SAPS will only consider exceptions in extremely rare and highly motivated situations. The law limits ownership to a single Section 13 firearm, and applying for a second firearm under this section is uncommon and subject to strict scrutiny. This limitation reflects the intent of the category: to authorise only the level of armament needed for personal protection, not for sport or collection.
The licence also imposes an ammunition restriction, allowing the holder to keep no more than 200 rounds for the specific firearm licensed under Section 13. This cap is part of the overall safety and risk-management framework of the Act, which aims to prevent excessive stockpiling of ammunition by limiting the quantity to what is considered reasonable for self-defence purposes.
A Section 13 licence is valid for a period of five years, after which it must be renewed before the expiry date. Renewal requires a timely application—at least ninety days before the licence expires—to avoid complications that may lead to the licence lapsing. Because a lapsed self-defence licence can result in the firearm becoming illegal to possess, staying aware of expiry dates and submitting renewal documents early is an essential responsibility for anyone licensed under this section.
